Award variation - First Aid - On Call and Recall - Sleepover - consent matter - application granted - award varied - operative ffpp 14 July 1998.

REASONS FOR DECISION

This application, lodged by the Australian Municipal, Administrative, Clerical and Services Union (the applicant), was for the purpose of varying the First Aid allowance, the On Call and Recall allowance and the Sleepover allowance contained in the Community Services Award.

This matter came before the Commission with the consent of all parties.

With the exception of the First Aid allowance, Mr I Paterson, for the applicant, sought to have the previously mentioned allowances increased by the cumulative effect of past increases arising out of the safety net adjustments granted by the Commission.

Mr Paterson relied on the following safety net adjustments to support his application:

In respect of the First Aid allowance, Mr Paterson informed the Commission that the allowance had, in the past, been increased, arising out of the July 1997 $10.00 safety net adjustment and he was not seeking to include that amount in this application. However, he said, the application to vary the First Aid allowance did include all other safety net variations.

Mr Paterson submitted that the application was consistent with the Wage Fixing Principles and he requested the variation be operative from the first full pay period to commence on or after 14 July 1998.

Mr C Brown, for the Health Services Union of Australia, Tasmania No. 1 Branch, supported the application and the consent operative date.

Mr M Watson, for the Tasmanian Chamber of Commerce and Industry Limited, also supported the application and consented to the operative date sought by the applicant. He informed the Commission that the application was consistent with the Wage Fixing Principles and it did not offend the public interest requirements of the Act.

I endorse the submissions of the parties and hereby determine that the application is consistent with the Wage Fixing Principles and does not offend the public interest requirements of the Act, therefore the award will be varied in the manner sought.

The variation will be operative from the first full pay period to commence on or after 14 July 1998.

The Order giving effect to this decision is attached.
