Award variation - sixth minimum rates adjustment for non-trade classifications - order issued - operative ffpp 1.9.98

REASONS FOR DECISION

This application was lodged by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union to vary Clause 8, Wage Rates, of the Shipbuilders Award by inserting the sixth minimum rates adjustment for non-trade classifications.

Mr Baker, representing the applicant union, in presenting a draft order, submitted that the adjustment sought was the final adjustment in the minimum rates adjustment process for the Shipbuilders Award and had application to non trades classifications at levels 3, 2 and 1.

Mr Baker submitted that the application was consistent with the wage fixing principles which were adopted in T7702 of 1998, in particular Principle 5, Minimum Rates Adjustment. An operative date of the first full pay period to commence on or after 1 September 1998 was requested.

Mr Benson, representing the Construction, Forestry, Mining and Energy Union, Tasmanian Branch, supported the submissions of Mr Baker and the proposed operative date.

Mr Edwards, for the Tasmanian Chamber of Commerce and Industry Limited, indicated the Chamber consented to the award being varied to incorporate the sixth and final minimum rates adjustment with effect from the first full pay period to commence on or after 1 September 1998. As a machinery issue, Mr Edwards submitted that the supplementary payments column in clause 8 of the award should be deleted in conformity with State Wage Case decisions.

Mr Edwards said the application was consistent with the Wage Fixing Principles enunciated by the Commission in T7702 of 1998, and the public interest test imposed by section 36 of the Act would not be offended.

It was agreed that the draft order would be revised and that the rates in the Base Rate column and Supplementary Payment column should be amalgamated and appear in one Base Rate column. As a consequence subclause (e) Supplementary Payment, is to be deleted from Clause 8.

I accept the submissions of the parties and, for the reasons they outlined, I approve the variation which is reflected in the order attached. The new rates of pay take effect from the first full pay period to commence on or after 1 September 1998.
