REASONS FOR DECISION

On 31 July 1998, an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, The Australasian Meat Industry Employees Union, Tasmanian Branch (the applicant), to vary the Meat Retailing Award (the award) by inserting the third Minimum Rate Adjustment.

At the commencement of the hearing on 9 September 1998, Mr G Courtney, on behalf of the applicant, presented an agreed draft Order (Exhibit C.1) which increased the rates appearing in the supplementary payment column, contained in the award, to reflect the third Minimum Rate Adjustment. The parties agreed the variations be operative from the first full pay period to commence on or after 9 September 1998.

As a consequence of varying the award to reflect the third Minimum Rate Adjustment, the draft Order also varied the supplementary payments as shown in the current award to be operative from the first full pay period to commence on or after 14 October 1998, arising out of the State Wage Case (T7702 of 1998) and appearing in Order No. 2 of 1998 for the Meat Retailing Award.

Mr D Dilger, of the Tasmanian Chamber of Commerce and Industry Limited and the National Meat Association of Australia (Tasmanian Division) presented submissions in support of the application. It was also his view that the application was consistent with: the Wage Fixing Principles; the public interest requirements of the Act; and, the previously agreed program established for the Minimum Rate Adjustments to this award.

I accept the submissions of the parties and the reasons they presented for varying the award. Therefore, I hereby determine the award be varied in the manner set out in the Order attached to this decision.
