TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or award variation

Tasmanian Trades and Labor Council
(T7891 of 1998)

NATIONAL TRAINING WAGE (TASMANIAN PRIVATE SECTOR) AWARD

COMMISSIONER R J WATLING

HOBART, 17 August 1998

Award variation - Schedule A - operative ffpp 17 August 1998 - consent matter - application granted

REASONS FOR DECISION

The National Training Wage (Tasmanian Private Sector) Award (the award) has application across a number of awards of the Commission. Those awards are specified in Schedule A to the award.

On 7 August 1998, an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, by the Tasmanian Trades and Labor Council (the applicant), to vary the National Training Wage (Tasmanian Private Sector) Award by inserting the Group Training Industry Award into Schedule A of the award.

The matter came before the Commission as a consent application.

Ms Fitzgerald, on behalf of the applicant, informed the Commission that this amendment would allow employers falling within the scope of the award to access the National Training Wage (Tasmanian Private Sector) Award when employing trainees. She said that the application was consistent with previous decisions of the Commission and the Wage Fixing Principles.

Mr T J Edwards, on behalf of the Tasmanian Chamber of Commerce and Industry Limited, advised the Commission that the organisation he represented consented to the variation being sought and agreed with the submission presented by Ms Fitzgerald.

Having heard the submissions of the parties I am satisfied that the application should be granted as it is consistent with:

a) the Wage Fixing Principles;

b) the public interest requirements of the Act; and

c) previous decision of the Commission dealing with similar applications.

The Order (Correction Order) giving effect to this decision is attached and will be operative from the first full pay period to commence on or after the 17 August 1998.
