Award variation - Clause 8 - $14.00 Safety Net Increase - approved - operative ffpp 2 October 1998 ($10pw) and operative ffpp 14 October 1998 ($4pw and Clause 11 - Certificate Allowance increase) REASONS FOR DECISION This was an application made under Section 23(1) of the Act by the Shop, Distributive and Allied Employees Association - Tasmanian Branch (the Union) seeking a variation to the Hairdressers Award (the Award) in line with the Arbitrated Safety Net Adjustment Principle set out in the Commission's State Wage Case 1998 decision in matter T7702 of 1998 (the State Wage Case Decision) The Union referred to the draft order in the application and advised the Commission it was seeking the implementation of the State Wage Case decision in the Award because it had expected to reach an overall agreement on the Award, but, settlement could not be reached. The Union canvassed the proposed amendments and submitted to the Commission that they were consistent with the Principles of the Commission and the methodology enunciated in the State Wage Case decision. The Union noted that the Minimum Rates Adjustment process was yet to be applied to the Award. The Tasmanian Chamber of Commerce and Industry Limited (the Chamber) did not appear at the hearing, but, the Union produced a copy of a letter from the Chamber indicating its agreement to the application. I accept the submissions of the Union: the Award will be amended as requested. Principle 8 - Arbitrated Safety Net Adjustments, provides:
Accordingly the dates of operation for the relevant increases will be the ffpp 2 October 1998 ($10 pw) and the ffpp 14 October 1998 ($4 pw and Clause 11 - Certificate Allowance increase). An Order is attached.
