TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s23 application for award or variation of award

Australian Mines and Metals Association (Incorporated)
(T8030 of 1998)

TEMCO ENTERPRISE AWARD

COMMISSIONER P A IMLACH

HOBART, 30 October 1998

Award variation - salaries - allowances - operative from date of decision - application granted - order attached

REASONS FOR DECISION

This was an application made under Section 23(1) of the Industrial Relations Act 1984 (the Act) by the Australian Mines and Metals Association (Incorporated) (the Association) for a variation to be made to the Temco Enterprise Award (the Award).

In particular, the application sought to transfer into the Award the rates of pay, shift allowances and travel expenses presently specified in the Temco Workplace Agreement 19961.

The Association submitted in support of its application that it did not offend the requirements of the Act nor the Principles of the Commission and its approval was in the public interest.

The four unions represented at the hearing each supported the Association's submissions and sought approval for the application.

I accept the submissions of the parties and I agree in particular that the application fulfils the requirements of Principle 3 - Enterprise Bargaining.

The application is approved with effect from the date of this decision.

An order is attached.
