Award variation - apprentices and unapprenticed juniors - MRA operative ffpp 1 December 1999 REASONS FOR INTERIM DECISION This was an application made under section 23 of the Industrial Relations Act 1984 (the Act) by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union for, amongst other things, the implementation of the Minimum Rates Adjustment (MRA) process in the Metal and Engineering Industry Award (the Award) for apprentices and unapprenticed juniors. When the MRA process was implemented in the Award previously these two groups of employees were omitted and the purpose of this part of the application was to change that omission. This particular item in the various matters included in the application was agreed between the parties in every detail and put to the Commission for resolution forthwith, whereas the other matters remained the subject of continued negotiation and settlement. A schedule of the agreed MRA payments and appropriate operative dates was with this first step commencing from the first full pay period on or after 1 December 1999 was presented to the Commission. The schedule provided for four incremental payments in six monthly instalments. In requesting that the Award be amended, the parties submitted to the Commission that the proposed variation, the first MRA, was consistent with the Principles of the Commission, it was not against the provisions of the Act and its implementation would not offend against the public interest as prescribed in the Act. I accept the submissions of the parties; the Award will be amended as sought, operative from the agreed date, the first full pay period commencing on or after 1 December 1999. It will be the responsibility of the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union (or another party to the Award) to apply in advance for each following MRA to be implemented. The hearing of all the other matters raised in the application will resume as soon as the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union is prepared and requests the Commission to proceed. An order is attached.
