REASONS FOR DECISION

On 18 January 1999, an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, by The Australasian Meat Industry Employees Union, Tasmanian Branch (the applicant), to vary the Meat Retailing Award (the award) by inserting the fourth and final Minimum Rate Adjustment.

At the commencement of the hearing on 2 March 1999, Mr G Courtney, on behalf of the applicant, presented an agreed draft Order (Exhibit C.1) which increased the rates appearing in the base rate column, which now include the supplementary payments contained in the award, to reflect the 4th and final Minimum Rate Adjustment. The parties agreed the variations be operative from the first full pay period to commence on or after 3 March 1999.

Mr T J Edwards, of the Tasmanian Chamber of Commerce and Industry Limited and the National Meat Association of Australia (Tasmanian Division) presented submissions in support of the application. It was also his view that the application was consistent with: the Wage Fixing Principles; the public interest requirements of the Act.

I accept the submissions of the parties and the reasons they presented for varying the award. Therefore, I hereby determine the award be varied in the manner set out in the Order attached to this decision.
