Industrial dispute - re conditions of employment in respect of employee Megan Cooke and re alleged breach of the Clerical and Administrative Employees (Private Sector) Award in respect of the employment of Megan Cooke and alleged non payment of entitlements on termination of her employment - matter settled - consent order issued

REASONS FOR DECISION

These applications were lodged by the Australian Municipal, Administrative, Clerical and Services Union (the Union) pursuant to Section 29 of the Industrial Relations Act 1984, for a hearing in relation to a dispute with Cynfar Pty Ltd trading as Customer Electronic Services.

The Union was in dispute with Customer Electronic Services over conditions of employment in respect of employee Megan Cooke and alleged breach of the Clerical and Administrative Employees (Private Sector) Award in respect of her employment.

Application T8279 of 1999 was listed for hearing on 12 March 1999 and again on 23 April 1999 when the employer failed to appear. On the same day the applicant lodged T8386 of 1999 to ensure that all of the issues between the parties could be dealt with at a subsequent hearing. T8386 of 1999 was also referred to me by the President and both matters were listed on 13 May 1999.

The disputed matters were resolved by the parties who agreed that I should issue a consent order reflecting their agreement. Therefore in accordance with s.31(1) of the Act I order by consent that Cynfar Pty Ltd trading as Customer Electronic Services, 2a Pierce Street, Moonah pay to Megan Cooke the sum of $8,505.90 as follows:

Nothing in the above order prevents the employer from making additional payments at any time or from making full settlement at any time prior to 17 December 1999.

I note the parties agreement to settle an outstanding superannuation payment to Ms Cooke by the Employer making three equal instalments of $375.38 in June, September and December 1999.
