Industrial dispute - wage rates - Building and Construction Industry Award - application withdrawn - file closed REASONS FOR DECISION On 4 August 1999, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (the applicant), applied to the President, pursuant to s.29(1) of the Industrial Relations Act 1984, for a hearing before a Commissioner in respect of an industrial dispute with Colony 47 Inc., arising out of an alleged failure of the company to comply with Clause 8 - Wage Rates, of the Building and Construction Industry Award. On 9 August 1999, the President convened a hearing before myself, to commence on Tuesday 21 September 1999 at 10.30 am. Mr A Benson represented the applicant, and Mr D Bessell, of Page Seager, Barristers and Solicitors, sought and was granted leave to appear for and on behalf of the Colony 47 Inc. At the commencement of the hearing, Mr Benson, requested the application be withdrawn. Given the foregoing, and pursuant to s.21(2)(c)(iv) of the Act, this matter is dismissed and the file closed.
