Rule change

REASONS FOR DECISION

This application was lodged by the Tasmanian Correctional Officers Association pursuant to Section 67(2) of the Industrial Relations Act 1984 and sought to effect an alteration to its membership rule to reflect changes that have occurred over time at Tasmanian Prisons.

The changes sought only to change the name of Her Majesty's Gaol Department to Tasmanian Prisons as it is currently known, and to replace no longer used position titles in the exclusion listing of officers eligible to be members of the Tasmanian Correctional Officers Association with current operational titles. Nursing staff were added to the exclusion listing as the Tasmanian Correctional Officers Association currently has none as members and organisations already exist to which they could conveniently belong.

After hearing the applicant and considering the requirements of Section 67(4) I hereby approve the application.

The altered rule, including other changes previously notified pursuant to Section 67(6)(b), will appear as follows:

    4. MEMBERSHIP

    a) Every officer of Tasmanian Prison shall be eligible for membership of the Association with the Exception of the General Manager Risdon Prison Complex, Operations Manager Risdon Prison Complex, Accommodation Manager Risdon Prison Complex, Manager Hayes Prison Farm, Manager Launceston Remand Centre, Manager Hobart Remand Centre, Nursing Staff, Executive Officer, Administrative Staff and Boiler Attendants.

    b) No person shall be admitted for membership until a written application made and signed by him/her has been approved by the Executive Committee and/or a General Meeting.

    c) Subject to payment of all arrears and current subscriptions any member may resign from the Association by giving three months notice in writing to the Secretary, or paying an amount equivalent to three months subscription in lieu of notice as per Rule 44. Any member who shall cease to be employed in Tasmanian Prisons shall cease to be a member of the Association but shall be liable to pay all subscriptions to the date when he/she should so cease to be a member.

    d) Any member may be expelled from membership of the Association by the Executive Committee if it considers such expulsion in the best interests of the Association. Any member so expelled shall have the right of appeal to a General Meeting of the Association called for that purpose.

    e) Any member who has been expelled may be re-admitted to the membership upon such conditions as the Executive Committee shall determine.

    f) Religion, colour, politics, creed or race shall have no bearing on the application for membership.
