Industrial agreement - agreement not approved - application dismissed

REASONS FOR DECISION

This was an application to the Acting Registrar made jointly under section 55 of the Industrial Relations Act 1984 (the Act) by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union (the Union) and Brambles Australia Ltd trading as Brambles Industrial Services of Cooee (the Company) for the filing of an industrial agreement: it was referred to the Commission for approval.

The agreement was to be known as the Brambles Industrial Services - Tasmanian Equipment Servicing Agreement 1999 (the agreement): it was to operate from the first full pay period commencing on or after 1 July 1999, for a period of two years.

The Commission was advised that the agreement reflected basically the same as a previous agreement, except that it provided for a wage increase of 4% over a period of twelve months, plus a further 1%, together with a 1% increase should certain performance indicator targets be met. For the second twelve months of the agreement, a 1% wage increase, plus a further 1% increase for meeting performance indicator targets was provided.

The Commission was not advised of any efficiency measures agreed between the parties (and none were incorporated in the agreement), which, under the Principles of the Commission, in particular, Principle 3, Enterprise Bargaining at 3.2.1 and 3.2.2, would have enabled the projected wage rates increases to be approved.

For these reasons, the agreement is not approved and the application is dismissed.
