TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

Tasmanian Chamber of Commerce and Industry Limited
(T8937 of 2000)

NATIONAL TRAINING WAGE (TASMANIAN PRIVATE SECTOR) AWARD

COMMISSIONER R J WATLING

HOBART, 1 June 2000

Award variation - Schedule A - deletions, amendments and extension to list of industries covered - consent matter - application granted - award varied - operative date 30 May 2000

REASONS FOR DECISION

On 13 April 2000, an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, by the Tasmanian Chamber of Commerce and Industry Limited (the applicant).

The applicant sought to vary Schedule A contained in the National Training Wage (Tasmanian Private Sector) Award, by:

  • deleting the Abattoirs Award as it is an obsolete award of the Commission;
  • replace the Meat Industry Award with its new title, namely, Meat Processing Industry Award
  • replace the Meat Trades Award with its new title, namely, Meat Retailing Award
  • insert three new awards, i.e. the Business Services Award, the Butter and Cheese Makers Award and the Dairy Processing Award.

When the matter came on for hearing on 30 May 2000, the applicant was represented by Mr T.J. Edwards and an appearance was entered by Mr R Flanagan of The Australian Workers' Union, Tasmania Branch.

The parties informed the Commission of their consent to the award being varied.

Having heard the submissions from the parties, I am satisfied that the industries specified in the scope of the awards to be included in Schedule A of the National Training Wage (Tasmanian Private Sector) Award have established approved vocational pathways for traineeships in those industries. Therefore, I approve the application as it is consistent with the public interest test required under the Act.

The Order giving effect to this decision is attached and will be operative on and from 30 May 2000.
