Award variation - apprentices and unapprenticed juniors - second MRA operative ffpp 1 June 2000 REASONS FOR DECISION This was an application made under section 23 of the Industrial Relations Act 1984 (the Act) by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union (the union) for a variation to be made to the Metal and Engineering Industry Award (the award). The union was seeking to have the second Minimum Rates Adjustment (MRA) instalment for apprentices and unapprenticed juniors included in the award Originally this particular group of employees had been omitted from the general MRA implementation in the award. The union reminded the Commission that the MRA process for apprentices and unapprenticed junior employees had been introduced to the award in December 1999 in matter T7268 of 1997 (part heard) at which time, relying on Principle 5 of the Commission's Principles, the parties had produced a draft order, together with an MRA implementation schedule containing dates and increase amounts for four lots of stepped increases. The union produced a draft order consistent with the schedule of implementation and advised the Commission that the operative date sought, the first full pay period to commence on or after 1 June 2000, was also consistent with that scheme. On this basis, the union requested that the application be approved. The Tasmanian Chamber of Commerce and Industry Limited confirmed the submissions of the union and advised the Commission of its consent to the application, the draft order and the date of operation. I accept the submissions of the parties; the award will be varied as requested, operative from the agreed date. An order is attached.
