REASONS FOR DECISION

This application, lodged by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union (the applicant), was for the purpose of varying the Automotive Industries Award to insert a new clause to provide for carer's leave, thus giving effect to a Full Bench decision arising out of applications T6296 of 1996 and T6441 of 1996.

Mr P Baker, on behalf of the applicant produced an agreed draft Order (Exhibit B.1), which varied from the draft model clause arising out of the previously mentioned Full Bench decision, only to the extent that it was made consistent with the Automotive Industries Award.

Mr M Watson, of the Tasmanian Chamber of Commerce and Industry Limited, advised the Commission that the organisation he represented consented to the variations in the form outlined in the draft Order. He said the application was consistent with the Wage Fixing Principles, the public interest and the decision arising out of the Full Bench dealing with the subject matter of this application.

I accept the submissions of the parties and grant the application as it is consistent with previous decisions of the Commission, especially those arising out of applications T6296 of 1996 and T6441 of 1996.

The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 7 December 2000.
