Award variation - apprentices and unapprenticed juniors - third Minimum Rates Adjustment - operative ffpp 5 December 2000

REASONS FOR DECISION

This was an application for a variation to the Metal and Engineering Industry Award (the Award) made under section 23 of the Industrial Relations Act 1984 (the Act) by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union (the AFMEPKIU).

The AFMEPKIU sought to vary the Award by applying a third Minimum Rates Adjustment (MRA) for Unapprenticed Juniors and Apprentices as specified in the Award.

In its submissions the AFMEPKIU reminded the Commission that the introduction of the MRA process in this small segment of the Award began with application No. T7268 of 1997. In that matter a schedule of agreed MRA payments and operative dates had been presented.

In accordance with that previous agreed schedule the operative date for this third step was from first full pay period commencing on or after 5 December 2000. A fourth step remains.

The AFMEPKIU requested approval of the application submitting that it was made in accordance with the Principles of the Commission and its implementation was not against the public interest as specified in the Act.

The Australian Workers' Union, Tasmania Branch (AWU) supported the application on the same grounds as the AFMEPKIU.

The Tasmanian Chamber of Commerce and Industry Limited indicated its consent to the application, including the operative date, and also said it was consistent with the Principles of the Commission and the public interest.

I accept the submissions of the parties. The Award will be varied as requested operative from first full pay period commencing on or after 5 December 2000.

An order is attached.
