REASONS FOR DECISION

This was an application by the Shop, Distributive and Allied Employees Association, Tasmanian Branch (the Union), made under Section 23(1) of the Industrial Relations Act 1984, seeking a variation of the Hairdressers Award (the Award)

The Union sought to have the Safety Net Adjustment increase of $15.00 per week granted in the State Wage Case July 2000 Full Bench decision in matter T9062 of 2000, implemented in the Award.

At the hearing of this application the Union produced a draft order reflecting the variation sought for the Award. The Union advised the Commission that the application was a consent matter and submitted that it conformed with the Principles of the Commission and its approval was not against the public interest.

The Union requested that the increase sought be made to commence operation on the first full pay period to commence on or after 1 January, 2001 as agreed between the parties.

The Retail Traders Association of Tasmania (the Association) confirmed its agreement to the application and also submitted that it abided by all the requirements. The Association said that the agreed claim had come about as a result of goodwill and cooperation between the parties.

On the same basis the Tasmanian Chamber of Commerce and Industry Limited (the Chamber) indicated their consent and support for the application based on the reasons already advanced and including the agreed operative date.

The Chamber sought an assurance from the Union that, in consideration of the Chamber's agreement to the present application, the operative dates for the proposed Minimum Rates Adjustment Process (MRA) in the Award be confirmed as agreed.

The Union did confirm its agreement to the proposed MRA process dates of implementation as set out in its letter to the Association, dated 1 November, 2000.

I accept the submissions of the parties and the application is approved, operative from the agreed date.
