Rescission of award - Federal award - award rescinded - operative ffpp 9 March 2001 REASONS FOR DECISION This was an application made under Section 32(7A) of the Industrial Relations Act 1984 (the Act) by the Tasmanian Chamber of Commerce and Industry Limited (the Chamber) seeking the rescission of the Marine Boards Award (the State award). At the hearing, in requesting the Commission to rescind the award, the Chamber relied on the grounds that an award of the Australian Industrial Relations Commission (the AIRC), the Marine Boards (Tasmania) Award 19961, had been made which completely covered all the areas presently contained in the scope of the award and by a decision of a Full Bench of the AIRC2, a draft order was given granting exclusive rights of union coverage to The Maritime Union of Australia (the MUA), the Australian Maritime Officers Union (the AMOU) in that Federal award. In these circumstances the Chamber submitted that the State award no longer served any useful purpose and consequently requested that it be rescinded. Prior to the hearing, the Commission had received correspondence from the AMOU, the MUA and the Australian Municipal Clerical and Services Union, Tasmanian Branch, advising their assent or non-objection to the proposed rescission. I accept the submissions of the Chamber and the State award will be rescinded from the date of this decision. As required by Section 32(7A) of the Act, a notice to that effect will be inserted in the Gazette. An order is attached.
