Award variation - Clause 9 Annual Leave - application granted - operative ffpp 21/5/01

REASONS FOR DECISION

This was an application made under section 23(1) of the Industrial Relations Act 1984 (the Act) by the Tasmanian Chamber of Commerce and Industry Limited (the Chamber) seeking a variation to the Metal and Engineering Industry Award (the award).

The Chamber sought to clarify the prescriptions in the award (at Clause 9 - Annual Leave, sub-clause (g)) "Payment for Period of Annual Leave" as it applied to shift workers and day workers respectively.

A draft order specifying the changes was produced by the Chamber.

The Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union advised its consent to the variation.

The parties, in requesting approval for the variation, submitted that it was within the Principles of the Commission and not against the public interest as prescribed.

The consent variation was to operate also by agreement from the first full pay period commencing on or after 21 May 2001.

I accept the submissions of the parties and the award will be amended as sought from the agreed operative date.

An order is attached.
