Making of new award - title - scope - statutory interest - application approved

REASONS FOR DECISION

This was an application made under section 23(1) of the Industrial Relations Act 1984 (the Act) by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (the CFMEU) for the making of the Mobile Crane Hire Award (the award).

At the initial hearing of this application, in seeking to have the award made, the CFMEU advised the Commission that there was a Federal award existing which related to the kind of work intended to be covered by this application. Moreover, the Union said the provisions proposed in this application mirrored those set out in the Federal award.

The CFMEU also submitted that the granting of the application would not be contrary to the First Award Principle of the Commission.

The Tasmanian Chamber of Commerce and Industry Limited (the Chamber) confirmed the award was the same as the Federal award and that it was not opposed to the making of the award.

I accept the submissions of the parties: the award is approved in relation only to the title and scope and statutory interest and an order is attached, operative from the date of this decision.

The application will be adjourned to enable those registered organisations who are eligible to apply to the President, in accordance with Section 65A of the Act, to have an interest in the Award specified in their certificates of registration. Upon completion of those formalities, the hearing will be resumed.
