REASONS FOR FURTHER DECISION

In my Reasons for Decision dated 12 January 2001, I approved a consent application to insert a 'savings provision' in the Barristers and Solicitors Award (the award), as a protection against employees having their wage rates reduced when translating to the new classification structure, arising out of application T9222 of 2000.

After releasing that decision, it was brought to my attention that the order sought by the parties and outlined in exhibit P1, during the hearing on 12 January 2001, was an earlier version considered by them, however, their final agreed position was to request the Commission to include in Part 111 Clause 2 the following:

"(d) No employee will have his or her salary reduced as a result of translation to the classifications described in Part 111 Clause 1 CLASSIFICATION DESCRIPTORS."

I accept the redrafted version of the order and approve the variation for the reasons stated in my Reasons for Decision dated 12 January 2001.

The Order giving effect to this decision will be issued in due course and will be operative from the first full pay period to commence on or after 11 December 2000.
