Award variation - Second Minimum Rates Adjustment - consent matter - Principles satisfied - application granted - award varied - operative date ffpp 3 April 2001 REASONS FOR DECISION On 6 October, 2000, the Commission handed down a decision arising out of an application1 that varied the Produce Award to include the first minimum rates adjustment operative from the first full pay period to commence on or after 7 September 2000. This current application was lodged with the Commission for the purpose of varying the Produce Award to reflect the second minimum rates adjustment for the same categories of employees. The parties presented an agreed position in support of the variation in wage rates with an operative date of the first full pay period to commence on or after 3 April, 2001. Having had the benefit of hearing the submissions of the parties and having considered the content of the draft Order, Exhibit P1, I hereby determine that the award be varied in the manner sought by the parties, as it is consistent with the Wage Fixing Principles and the public interest requirements of the Act and is the second phase of the agreed minimum rates adjustment process for this award. The Order giving effect to this decision is attached and it will be operative first full pay period to commence on or after 3 April 2001.
