Award variation - award updated - application granted - operative ffpp 23/7/01 REASONS FOR DECISION [1] This was an application made under section 23(1) of the Industrial Relations Act 1984 (the Act) by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (the Union) for a variation to be made to the Mobile Crane Hire Award (the award). [2] The award was first made on 19 March 2001. By Order 2 of 2001, dated 2 May 2001, the award Interest was varied. [3] In this application the Union sought the provision of wages and conditions of employment generally found in awards, but, in this case, peculiar to the scope of the award. [4] The award was intended to be a mirror of the Mobile Crane Hire Award 1996 of the Australian Industrial Relations Commission and, except for amendments deemed necessary for this jurisdiction, remains so. [5] After some hearings, discussions and negotiations, the parties were able to present the Commission with an agreed draft amendment to the Award. [6] I am satisfied that the terms of this application are in accordance with the Principles of the Commission and they do not offend the public interest as prescribed in the Act. In particular, they comply with the requirements of the Commission's Principle 10, First Award and Extension to Existing Award. [7] The application is approved, operative from the first full pay period commencing on or after 23 July 2001. An order is attached.
