Industrial dispute - redundancy - severance pay - order - file closed REASONS FOR DECISION [1] This was an application for a dispute hearing made under section 29(1A) of the Industrial Relations Act 1984 (the Act), by Casey Janet Rockliff of Burnie. [2] Ms Rockliff was in dispute with Camdale Management Pty Ltd ACN 079 831 011 (In Liquidation) of Camdale (the Company) over severance pay in respect of termination of employment as a result of redundancy. [3] Under an order of the Supreme Court of Tasmania, the Company went into liquidation on 14 May 2001, at which time Ms Rockliff's employment ceased. [4] Ms Rockliff commenced employment with the Company on 1 February 1999. She sought an order for a severance payment from the Company. At the time of the termination of her employment, Ms Rockliff was in receipt of a gross weekly wage of $572.61. [5] At the hearing of this application, Ms Rockliff appeared as a witness and confirmed to relevant facts cited. She also produced a number of payslips as evidence. Other relevant facts were supplied to the Commission by the liquidator. [6] The Company was not represented at the hearing. [7] I am satisfied that, on the evidence before me, Miss Rockliff is entitled to a severance payment on the basis of two weeks' pay for each year of service or part thereof, that is, for two years and three and a half months. Order [8] In accordance with the power vested in me under Section 31(1) of the Industrial Relations Act 1984, in settlement of this dispute, I hereby order that Camdale Management Pty Ltd ACN 079 831 011 (In Liquidation) of 22 Besser Crescent, Camdale, Tas 7320, within twenty-one days of the date hereof, pay to Casey Janet Rockliff of Unit 1, 1 Cedar Place, Burnie, Tasmania 7320, the sum of two thousand, four hundred and fifty-seven dollars and forty-five cents ($2,457.45) being due as a severance payment.
