REASONS FOR FURTHER DECISION

In this matter the applicant seeks reinstatement on the grounds that he was unfairly dismissed.

The respondent employer raised a preliminary argument that the Commission lacked jurisdiction to hear the matter. My reasons for finding in favour of the respondent are found in my decision dated 13 July 2001 in this matter.

Pursuant to Section 31 of the Act the application is rejected.
