Award variation - first MRA - application granted - operative ffpp 1/7/01

REASONS FOR DECISION

[1] This was an application made under section 23(1) of the Industrial Relations Act 1984 (the Act) by the Shop, Distributive and Allied Employees Association, Tasmanian Branch (the Union) for a variation to be made to the Hairdressers Award (the award).

[2] The Union sought to have the first Minimum Rates Adjustment (MRA) implemented in the award.

[3] After initial submissions, an adjournment of the hearing, and discussions between the parties separately and with the Commission, the parties returned and advised that agreement had been reached as to the implementation of the MRA process in the award. The first MRA was to be regarded as an interim increase only and the continuation of the MRA process was to be subject to the settlement of the review and re-structuring of the award within six months.

[4] The parties requested the Commission's endorsement of the agreed process.

[5] The Union also requested certain changes to the terminology of the award in relation to references to apprentices to make them more consistent with current training legislation. I consider it more appropriate that this part of the application not be endorsed, but, be dealt with by the review and restructuring process as agreed.

[6] In view of the circumstances in this matter and agreement of the parties, the application is approved on the basis of the submissions made. I am satisfied that the process adopted by the parties is not contrary to the Principles of the Commission, nor the public interest as prescribed in the Act.

[7] An order, operative from the agreed date, the first full pay period commencing on or after 1 July 2001, is attached.
