REASONS FOR DECISION

[1] On 24 July 2001, an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, by the Tasmanian Trades and Labor Council (the applicant).

[2] When the matter came on for hearing on 2 August 2001, the applicant was represented by Mr I Paterson. He said this application sought to essentially achieve two primary objectives; the first is to align the wage levels in the National Training Wage (Tasmanian Private Sector) Award to certificate levels and to encompass new provisions to deal with wage rates and other provisions for Certificate IV Traineeships; and it also encompassed some further matters relating to school-based traineeships.

[3] Mr Paterson said that in addition, there were also variations to more closely align the provisions of this award with the actual requirements under the Vocational Education and Training Act. In principle and in effect, this application flows on the changes made to the National Training Wage Award of the Australian Industrial Relations Commission which has been provided to the parties as a consent draft Order, Exhibit TTLC.2.

[4] Mr Paterson submitted that it is in the public interest and consistent with the Wage Fixing Principles of the commission to vary this award in this way and would be seeking, an operative date of the first full pay period on or after 1 August, such that there will be consistency with this order and that arising out of the State Wage Case.

[5] Mr Edwards presented an Exhibit TTLC.1 confirming the amendment sought and agreed with the proposed operative date being the first pay period to commence on or after 1 August 2001.

[6] The parties also requested that any order arising out of this application incorporate the wage and allowance increases arising out of the State Wage Case decision of the Tasmanian Industrial Commission T9605 of 2001.

[7] The award will be varied in the manner set out in the draft Order, with the operative date from the first full pay period to commence on or after 1 August 2001.

[8] The Order giving effect to this decision is attached.
