TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

Australian Municipal, Administrative, Clerical and Services Union
(T9704 of 2001)

PUBLIC ACCOUNTANTS AWARD

COMMISSIONER P A IMLACH

HOBART, 31 JULY 2001

Award variation - allowance for qualification - award updated - application granted - operative ffpp on or after 5/6/01

REASONS FOR DECISION

[1] This was an application made under section 23(1) of the Industrial Relations Act 1984 (the Act) by Australian Municipal, Administrative, Clerical and Services Union (the Union) for a variation to be made to the Public Accountants Award (the award).

[2] The parties pointed out to the Commission that, when the award was reviewed and consolidated recently (T7907 of 1998) the amounts specified in Part III Clause 1(c) Allowance for Qualification, by an omission, did not reflect amounts consistent with the various sequential State Wages Case increases which ought to have been applied up to, but, not including the State Wage Case of July 2001.

[3] This application sought to correct that omission, operative from the date of the recent consolidation, that is, the first full pay period commencing on or after 5 June 2001.

[4] In submissions, both the Union and the Tasmanian Chamber of Commerce and Industry Limited confirmed the omission and sought correction by way of variation.

[5] I accept the submissions of the parties and I am satisfied that the variation sought complies with the requirements of the Principles of the Commission and the Act.

[6] The award will be varied as requested, operative from the first full pay period commencing on or after 5 June 2001.

[7] An order is attached.
