Industrial Relations Act 1984
s.23 application for award or variation of award

Australian Municipal, Administrative, Clerical and Services Union
(T9758 of 2001)

PUBLIC ACCOUNTANTS AWARD

COMMISSIONER P A IMLACH

HOBART, 10 SEPTEMBER 2001

Award variation - kilometre allowance - annual leave - bereavement leave - award updated - application granted - operative ffpp 6 September 2001

REASONS FOR DECISION

[1] This was an application made under section 23(1) of the Industrial Relations Act 1984 (the Act) by Australian Municipal, Administrative, Clerical and Services Union (the Union) for a variation to be made to the Public Accountants Award (the award).

[2] The Union sought to vary the award in relation to three matters:

1 to increase the kilometre allowance provided for private vehicle use in accord with the latest Australian Tax Office prescription;

2 in Part VI Clause 1 - Annual Leave, to provide for a loading of 17½ per cent in lieu of a minimum wage provision, and

3 in Part VI Clause 2 - Bereavement Leave, to provide bereavement leave for an employee following the death of a member of the employee's household.

[3] In its submissions seeking approval of the application, the Union pointed out that the amendments sought were in line with decisions already taken by the Commission, or provided a more practical alternate prescription.

[4] The Tasmanian Chamber of Commerce and Industry Limited endorsed the submissions of the Union and confirmed with the Commission its agreement to the proposed variation.

[5] The award will be varied as requested, operative from the first full pay period commencing on or after 6 September 2001.

[6] I accept the submissions of the parties and the application is approved operative from the agreed date.

[7] An order is attached.
