Award variation - insertion of provision for Carer's Leave - application approved - operative date ffpp 7 November 2001

REASONS FOR DECISION

[1] On 16 October 2001 applications were lodged by the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Medical Diagnostic Services (Private Sector) Award, the Dentists Award and the Medical Practitioners (Private Sector) Award.

[2] When these applications came on for hearing Mr T Kleyn appeared for the HSUA, Mr M Watson for the Tasmanian Chamber of Commerce and Industry Limited and Mr D Lowe for the Australian Medical Association, Tasmanian Branch.

[3] Mr Kleyn explained that these applications sought to include Carer's Leave provisions in line with the Full Bench decision of 23 December 1996.1

[4] Both Mr Watson and Mr Lowe indicated consent to the applications.

[5] I am satisfied that the applications are consistent with both the Wage Fixing Principles and the Public Interest requirements of the Act.

[6] The Applications are granted effective from the beginning of the first full pay period to commence on or after 7 November 2001.(7) The Orders giving effect to this decision will be issued separately.
