REASONS FOR DECISION

(1) This is an application (as amended) pursuant to s.23 of the Industrial Relations Act 1984, made by The Association of Professional Engineers, Scientists and Managers, Australia (the applicant) and lodged on 13 November 2001. The application seeks to vary the Retail Pharmacy Award; and, in particular, the kilometreage allowance where employees are required to use their own vehicle.

[2] When the matter came on for hearing, the applicant was represented by Mr D Pyrke, and an appearance was entered by Mr R Rollins for the Tasmanian Chamber of Commerce and Industry Limited.

[3] Mr Pyrke presented Exhibit P.1, to indicate the upward movement in the Consumer Price Index - Transportation - weighted average of eight capital cities up to and including the June quarter 2001.

[4] Mr Rollins supported the submission of Mr Pyrke and consented to the award being varied in the manner sought by the applicant.

[5] Having heard the submissions from the parties, I am satisfied that the Retail Pharmacy Award should be varied in the manner set out in the draft order presented by the applicant. In approving the application, I am satisfied it is not contrary to the public interest test required pursuant to s.36 of the Act.

[6] The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 7 December 2001.
