REASONS FOR DECISION

[1] On 16 November 2001, an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, by the Australian Municipal, Administrative, Clerical and Services Union (the applicant), to vary the Barristers and Solicitors Award (the award) by inserting the third and final Minimum Rate Adjustment.

[2] The parties presented submissions, in support of the amended application.

[3] I approve the consent variation as it is consistent with the program agreed to by the parties arising out T9222 of 2000, Principle 2 of the Wage Fixing Principles, and the public interest requirements of the Act.

[4] The award will be varied in the manner set out in the amended draft Order attached to the application, with the operative effect from the first full pay period to commence on or after 11 November 2001.

[5] The Order giving effect to this decision is attached.
