REASONS FOR DECISION

(1) This is an application pursuant to s.23 of the Industrial Relations Act 1984, made by The Community and Public Sector Union (State Public Services Federation Tasmania) (CPSU) and lodged on 29 November 2001.

[2] The application sought to vary the North West Regional Water Authority Employees Award; and, in particular to:

· change the name of the award to the North West Water Authority Enterprise Award;

· update scope and award interest by replacing the reference to the "North West Regional Water Authority" with the "North West Water Authority trading as Cradle Coast Water"; and

· replace "NWRWA" with "employer" wherever appearing.

[3] When the matter came on for hearing, the applicant was represented by Mr T Lynch, and an appearance was entered by Mr Pyrke for the The Association of Professional Engineers, Scientists and Managers, Australia.

[4] Having heard the submissions from the parties, I am satisfied that the North West Regional Water Authority Employees Award should be varied in the manner sought by the applicant and, in approving the application, I am satisfied it is not contrary to the public interest test required pursuant to s.36 of the Act.

[5] The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 3 December 2001.
