Award variation - replacement of sub-clause (a) of Clause 1 - Salary Rates of Part III - SALARIES AND RELATED MATTERS - application granted - award varied - operative from ffpp 12 April 2002 REASONS FOR DECISION [1] On 5 March 2002, an application was lodged by The Association of Professional Engineers, Scientists and Managers, Australia, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Architects Award. [2] The application sought to vary the Architects Award; and in particular to implement the Second Minimum Rates Adjustments by varying Clause 1 - Salary Rates of part III - SALARIES AND RELATED MATTERS. [3] When the matter came on for hearing at `Lyndhurst', 448 Elizabeth Street, North Hobart, Tasmania on 18 March 2002 at 10.30 am, Mr D Pyrke appeared for The Association of Professional Engineers, Scientists and Managers, Australia and Mr J O'Neill appeared for the Tasmanian Chamber of Commerce and Industry Limited. [4] Having heard the submissions from the parties, I am satisfied that the Architects award should be varied in the manner sought by the applicant and, in approving the application, I am satisfied it is not contrary to the public interest test required pursuant to s.36 of the Act. [5] The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 12 April 2002.
