RECORD OF OUTCOME OF APPLICATION

This application was lodged, pursuant to s.29(1A) of the Industrial Relations Act 1984, on 7 June 2002 and was set down for hearing at `Lyndhurst', 448 Elizabeth Street, North Hobart, Tasmania on Tuesday, 25 June 2002 at 11.00 am. However, this was subsequently change to Thursday, 4 July 2002 at 10.30 am.

Appearances: Mr Brian John Leahy for himself (the applicant); Ms J Thomas from the Tasmanian Chamber of Commerce and Industry Limited, with Mr G Rosan for and on behalf of Business Solutions (Tasmania) Pty Ltd trading as Bartercard Southern Tasmania (the respondent).

After hearing preliminary submissions, the parties entered into private discussions in an attempt to settle the dispute. When the hearing reconvened, the parties informed the Commission that their negotiations had settled the dispute. However, they requested the hearing be adjourned to enable them to finalise the detail of the settlement. The hearing was adjourned sine die.

In correspondence dated 31 July 2002, the applicant informed the Commission that:

    "... my application T No. 10234 of 2002 be discontinued as I have settled the matter with my former employer."

Given the above, the proceedings are discontinued in accordance with s.21 of the Act.
