REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Shop Distributive and Allied Employees Association, Tasmanian Branch (the union) and Coles Logistics Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 26 June 2002, the Commission convened a hearing at the Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence at 11.30 am on 19 July 2002.

[3] The agreement, to be known as the Coles Myer Logistics Launceston Distribution Centre - SDA Industrial Agreement 2002, will apply to all employees of the employer at its Launceston Distribution Centre and will be operative from the first full pay period to commence on or after 7 April 2002 and remain in force until 6 April 2005.

[4] The agreement contains weekly wage rates and numerous conditions of employment. During the life of the agreement the weekly wage rates, applying immediately prior to the commencement date of this agreement, will be increased in the following manner:

  • 5% payable on and from 7 April 2002;
  • 2.9% payable on and from 7 April 2003; and
  • 2% payable on and from 7 April 2004.

[5] Mr J Russell for the union and Mr A Cameron for the employer presented submissions in support of their consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
