Industrial dispute - alleged unfair termination of employment - consent order ORDER BY CONSENT [1] This application was lodged by Michael John Allen (the applicant) on 26 June 2002, pursuant to Section 29(1A) of the Industrial Relations Act 1984 (the Act), for the purpose of settling a dispute with Underground Asset Services Pty Ltd (the respondent) arising out of the applicant's alleged unfair termination of employment. [2] At the hearing held in Launceston on 7 August 2002, Ms Maclaine-Cross of counsel sought and was granted leave of the Commission to appear for the applicant. Mr Griffiths of counsel sought and was granted leave of the Commission to appear for the respondent. [3] Following preliminary submissions, the hearing was adjourned into private conference, with the Commission, in an effort to find a resolution to the dispute. [4] At the conclusion of the conference the parties requested that a consent order be issued in the following terms. Order by Consent. Pursuant to s.31 of the Industrial Relations Act 1984, I hereby order that Underground Asset Services Pty Ltd, 10 Lambert Ave, Sandy Bay, 7005, pay to Michael John Allen, c/- Rae and Partners, 93 York Street, Launceston, 7250, a redundancy payment equivalent to six weeks' pay [$3117.00]. Such payment is to be made not later than 5 pm on Thursday, 22 August 2002.
