REASONS FOR DECISION

(1) This is an application pursuant to s.23 of the Industrial Relations Act 1984, made by the Tasmanian Chamber of Commerce and Industry Limited and lodged on 30 July 2002.

[2] The application sought to vary the Estate Agents Award; and, in particular by:

  • deleting all reference to "Real Estate Salespeople" and "Salespeople" and replace with "Real Estate Sales Consultants" and `Sales Consultants" respectively;

  • removing all reference to "Salesmen" and replace with "Sales Consultant";

  • amending Clause 8 - Wage Rates by deleting the classification Real Estate Sales Trainee as trainees in this area of employment obtain their rates of pay and conditions from the national Training Wage (Tasmanian Private Sector) Award; and, increasing the base rate for "Real Estate Sales Consultant, Auctioneer, Property Manager, Manager" by 40 cents.

  • removal from Clause 3 - Arrangements, and between Clause 8 - Wage Rates and Clause 9 - Annual Leave the words "Conditions for Employees in Division A - All classifications including Clerks, Rent Collectors and Trainee Valuers but Excluding Salesmen and Managers" and insert in lieu thereof "Conditions for Employees in division A - All Classifications other than Sales Consultants and Managers".

[3] The parties at the hearing presented consent submissions in support of the application and requested the award be varied with a common operative date of the first full pay period to commence on or after 1 August 2002.

[4] This application is approved, as it is consistent with the Wage Fixing Principles.

[5] The Order giving effect to this decision will be contained in the Order arising out of the State Wage Case decision (T10230 of 2002, T10288 of 2002 and T10289 of 2002).
