Industrial Agreement - agreement approved - operative 1 July 2002 until 9 January 2005 - forwarded to the Acting Registrar for registration REASONS FOR DECISION [1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Regional Imaging Limited (the employer), was for the purpose of filing an industrial agreement with the Commission. [2] On 23 August 2002, the Commission convened a hearing at the Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence on Monday 23 September 2002 at 11.30 am. [3] At the request of the Commission the matter was adjourned to 1 November 2002. [4] The agreement, to be known as the Regional Imaging Limited Tasmania (Administration and Operational Employees) Salaries and Conditions Industrial Agreement 2002, is to be operative on and from 1 July 2002 and it is to remain in force until 9 January 2005. [5] The agreement applies to all employees classified as Administrative and Operational (as defined) of Regional Imaging Limited employed pursuant to the Medical Diagnostic Services (Private Sector) Award. [6] Oral submissions were submitted by Mr T Kleyn of the Health Services Union of Australia, Tasmania No. 1 Branch and Mr G Faulkner of Regional Imaging in support of the Agreement [7] Having considered those submissions, I am satisfied the agreement should be approved as it satisfies s.36 of the Act. [8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
