Industrial dispute - application amended - extension of time - severance pay - Order issued - file closed

ORDER BY CONSENT

[1] This amended application, made by Mr Richard Errol Ford (the applicant) pursuant to s.29(1A) of the Industrial Relations Act 1984, sought a severance pay after his position was made redundant with his former employer, Barrett Developments Pty Ltd trading as Tas Sealife.

[2] The parties agreed, because of various circumstances, that the application, which was lodged some three months outside the time prescribed for lodgement, be extended.

[3] It was also agreed that the Commission issue the following Order with the consent of the parties.

ORDER BY CONSENT

I hereby Order, pursuant to s.31 of the Industrial Relations Act 1984, with the consent of the parties, that ACN 061 556 821 (in liquidation) formerly Barrett Developments Pty Ltd trading as Tas Sealife (the respondent), pay to Richard Errol Ford, Unit 1, 19 Howrah Road, Howrah, Tasmania, a severance pay of two weeks' pay for each completed year of service, plus a pro rata of the two weeks' pay for any incomplete year of service by 5.00 pm on Friday, 25 October 2002.

This Order is in full and final settlement of the industrial dispute stated in application T10391 of 2002.

Nothing in this Order shall be construed as to prevent the respondent from paying the above-mentioned sum prior to the due date.
