REASONS FOR DECISION

(1) On 11 September 2002 The Australian Workers' Union, Tasmania Branch and Adelaide Mushrooms (Nominees) Pty Ltd trading as Tasmanian Mushrooms lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tasmanian Mushrooms Agreement 2002.

(2) Appearances: Mr I Wakefield for The Australian Workers' Union; Mr J O'Neill of the TCCI for Adelaide Mushrooms [Nominees] Pty Ltd.

(3) Mr O'Neill submitted that this Agreement was identical to the Agreement approved by Commissioner Shelley on 24 December 20011, save for Rates of Pay contained in schedule 2.

(4) Mr Wakefield indicated that the Agreement had been endorsed by the membership affected at the farm and urged that the Agreement be approved.

(5) I am satisfied that the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

(6) Pursuant to s.55[4] of the Act the agreement is approved operative from the beginning of the first pay period to commence on or after 1 August 2002.

(7) The file is referred to the Acting Registrar in accordance with s.56[1] of the Act.
