REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the HSUA) and MIA Tasmania Pty Ltd. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 27 September 2002, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Thursday, 10 October 2002 at 11.00 am.

[3] The agreement, to be known as the MIA Tasmania Pty Ltd Industrial Agreement 2002, is to be operative from the first full pay period on or after 1 September 2002, and to remain in force for a period of three years.

[4] The agreement has application to the employment of all employees for whom a classification appears in Appendix A to the agreement or Clause 8 - Salary Rates.

[5] Mr M Watson, of the Tasmanian Chamber of Commerce and Industry Limited, for the employer, presented submissions in support of the application and foreshadowed, if this application was approved, the parties would take the necessary steps to withdraw from the agreement currently filed in the Commission in their names. Further, Mr Watson detailed the major differences between the current agreement and this application.

[6] Mr T Kleyn for the HSUA supported the submissions of Mr Watson.

[7] Having considered the submission of the parties, I am satisfied the agreement should be approved as it does not offend the public interest requirements of the Act, and I decide accordingly.

[8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
