REASONS FOR DECISION

[1] This application was made jointly to the Acting Registrar under Section 55 of the Industrial Relations Act 1984 (the Act) by the Health Services Union of Australia, Tasmania No 1 Branch (HSUA), and Regional Imaging Limited for the filing of an industrial agreement.

[2] The agreement was to be known as the Regional Imaging Limited (Professional Staff Salaries and Conditions) Industrial Agreement 2002 (the agreement): it was to operate from the first full pay period commencing on or after 1 April 2002, for a period of two years.

[3] Mr T Kleyn appeared for the HSUA and Mr G Faulkner appeared for Regional Imaging Limited.

(4) Mr Kleyn explained that hitherto, salaries and conditions of employment had been covered by a number of unregistered agreements. The Agreement which the parties sought to have registered was comprehensive and covered most, if not all conditions of employment for professional staff at the various sites throughout Tasmania.

(5) The classification structure and attendant salaries reflected the realities of the market place. This included a salary increase, which, subject to approval by the Commission, would apply from 1 June 2002.

(6) Mr Faulkner supported the submissions of Mr Kleyn.

(7) I am satisfied that the Agreement is consistent with the Wage Fixation Principles and the public interest requirements of the Act.

(8) Pursuant to Section 55[4] of the Act, the Agreement is approved operative from the beginning of the first full pay period to commence on or after 1 April 2002 and shall remain in force for a period of two years.

(9) The Agreement is referred to the Acting Registrar in accordance with section 56[1] of the Act.
