Industrial Agreement - agreement approved - operative 10 October 2002 - for a period of one year - forwarded to the Acting Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch (the AEU) and Work & Training Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 21 October 2002, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Friday, 1 November 2002 at 10.30 am.

[3] The agreement, to be known as the Work & Training Ltd - AEU School Based Traineeship Agreement 2002, is to be operative on and from 10 October 2002 and will remain in force for a period of one year.

[4] The purpose of the agreement is:

"(a) the development of appropriate employment conditions for School Based Trainees, which are no less than the entitlements of a non-school based trainee undertaking a similar traineeship;

(b) provision of an opportunity for secondary school students to undertake paid on the job training in order to achieve the specified qualification;

(c) improvement in the prospects of ongoing employment for the trainee."

[5] Mr R Hunt for the AEU and Mr B Lipscombe for the employer, presented submissions in support of the consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
