TASMANIAN CATHOLIC EDUCATION SALARIES ALLOWANCES AND CONDITIONS AGREEMENT NUMBER 2 OF 2002

REASONS FOR DECISION

[1] This application was lodged, pursuant to Section 55 of the Industrial Relations Act 1984, by the Tasmanian Catholic Education Employees' Association (the Association) and the Tasmanian Chamber of Commerce and Industry Limited (for the employers), for the purpose of filing the abovementioned industrial agreement with the Commission.

[2] The parties to the agreement are as follows:

    Tasmanian Catholic Education Employees' Association

    The Archbishop of Hobart in respect of employees employed at the:
          Catholic Education Office;
          MacKillop College;
          Mt Carmel College; and
          the schools listed in `Attachment A' of the agreement;

    Dominic College Incorporated;
    Guilford Young College Incorporated;
    Sacred Heart College Incorporated;
    The Provincial Council of the Christian Brothers - St Patrick's Province - Australia;
    St Mary's College Incorporated;
    Marist Regional College Incorporated;
    The Governing Council St Brendan-Shaw College; and
    The Governing Council St Patrick's College.

[3] The agreement, to be known as the Tasmanian Catholic Education Salaries Allowances and Conditions Agreement Number 2 of 2002, is to be operative from the first full pay period to commence on or after 1 November 2002 and will remain in force until 28 February 2003.

[4] This agreement replaces the salaries as listed in Clause 6 Salaries of the Catholic Education Agreement 2002 (T10045 of 2002) and if not listed in that agreement, then those listed in Clause 7 Salaries of the Catholic Education Agreement 2001 (T9668 of 2001), with effect from the first full pay period on/after 1 May 2002.

[5] The agreement also:

  • replaces work related allowances as listed in Clause 7 Work Related Allowances of the Catholic Education Salaries Allowances and Conditions Agreement 2002 (T10189 of 2002) with effect from the first full pay period on/after 1 February 2003.

  • provides, to the extent that provisions of this agreement differ from the Catholic Education Salaries Allowances and Conditions Agreement 2002 (T10189 of 2002) and the Catholic Education Agreement 2000 (T9026 of 2000), or the Catholic Education Award No. 2 of 2000 (Consolidated) the provisions of this agreement shall prevail.

[6] Ms A Briant, for the Tasmanian Catholic Education Employees' Association and, Ms J Thomas, of the Tasmanian Chamber of Commerce and Industry Limited, for the respondent employers, presented submissions in support of their consent application.

[7] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[8] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
