ICHIGO (SUPERANNUATION) INDUSTRIAL AGREEMENT

COMMISSIONER T J ABEY

HOBART, 10 December 2002

Industrial agreement - application approved - operative date 1 December 2002 - 3 years

REASONS FOR DECISION

(1) On 21 November 2002 The Australian Workers' Union, Tasmania Branch (AWU) and Ichigo Australia Pty Ltd lodged with the Acting Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Ichigo (Superannuation) Industrial Agreement.

[2] When this matter came on for hearing on 10 December 2002, Mr I Wakefield appeared for the AWU. Mr J Brown appeared for Ichigo Australia Pty Ltd.

[3] Mr Wakefield explained that this agreement sought to regularise arrangements in relation to superannuation. Contributions for all future employees will be paid into the Superannuation Trust of Australia. Employees who commenced prior to the date of operation of this Agreement will, at their election, be able to maintain existing arrangements.

[4] Mr Brown concurred with the submissions of Mr Wakefield.

[5] I am satisfied the Agreement does not offend the public interest requirements of the Act.

[6] Pursuant to section 55[4] of the Act the Agreement is approved operative from 1 December 2002 and shall remain in force for a period of three years.

[7] The file will now be referred to the Acting Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
