REASONS FOR DECISION

[1] All these applications which were eventually joined for hearing purposes were for variations to be made to the Metal and Engineering Industry Award (the award). They were made by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union (the union) and included a review of the award in accordance with the Structural Efficiency Principle of the Commission.

[2] The first of these applications T5998 of 1995 was made in December 1995, seeking to vary the award to make it consistent with variations made to the then Federal Metal Industry Award 1984 in that year.

[3] After the first application, additional applications to vary were made, in particular T6275 of 1996 concerning wage rates and adult apprentices, T6278 of 1996 concerning termination of employment and T7268 of 1997 concerning wage rates for unapprenticed juniors and the application of supplementary payments to all apprentices.

[4] In June 1999, all these applications were joined and matter T7268 of 1997 was used as the vehicle for further proceedings. Since then much negotiation took place between the parties and a number of hearings were held. Further, application T10163 of 2002, which sought the inclusion of the words "or equivalent" in relevant classification descriptors and in definitions contained in Appendix A, was also joined with all these applications.

[5] Ultimately, all matters were resolved between the parties and a draft order reflecting the agreed variations, including the award review changes, was produced.

[6] The applications, as amended, are approved.

[7] I am satisfied that all the variations agreed to be made to the award during the extended period of the examination of these applications and the review of the award comply with the requirements of the Act and the Principles of the Commission and their implementation is not against the public interest as prescribed.

[8] Also included in the consolidated award order attached are variations resulting from three other decisions1 recently handed down and operative from the same date, the first full pay period commencing on or after 1 July 2002.
