RECORD OF OUTCOME OF APPLICATION

This application was lodged, pursuant to s.29(1) of the Industrial Relations Act 1984, on 29 September 2000.

The matter was set down for hearing at `Lyndhurst', 448 Elizabeth Street, North Hobart, Tasmania on Monday, 2 October 2000 at 10.30 am.

Ms S Zeitz, of EMA Legal, Mr W J Fitzgerald of the Australian Mines and Metals Association (Incorporated) with Mr D Buscall and Mr P Edwards for Pasminco Rosebery Mining (the Company); and Mr R Flanagan, Mr I Wakefield, and Mr R Bennion for The Australian Workers' Union, Tasmania Branch (the Union).

After hearing preliminary submissions, the parties entered into private discussions in an attempt to settle the dispute.

After some nine hours of discussions the parties emerged without any definite resolution to the dispute.

Reasons for Interim Decision were issued, which included a nine-point proposal1 that Ms Zeitz had presented to facilitate the arrangements to be utilised by the Company should external contractors be engaged within the Rosebery Mine operations.

The Commission then strongly recommended that:

1. the parties adopt the proposal put forward by the Company as a reasonable way to proceed with the issues in dispute; and

2. the employees of the Company lift all bans and limitations to enable the processes outlined in the above mentioned proposal to proceed, including the regular report-backs to the Commission.

The hearing was adjourned sine die.

In correspondence dated 15 April 2002, The General Manager, Mr B F Fletcher, for the Company, advised the Commission that:

    "The Company requests that you formally close the matter."

Given the above, the proceedings are discontinued in accordance with s.21 of the Act.
