REASONS FOR DECISION

[1] This was an application made under section 23 of the Industrial Relations Act 1984 (the Act) by The Australian Workers' Union, Tasmania Branch (the Union) for a variation to be made to the Civil Construction and Maintenance Award (the award) (previously known as the Roadmakers Award).

[2] The Union was seeking to have the State Wage Case decisions of July 1999 (T8413 and T8483 of 1999), August 2000 (T9062 of 2000) and August 2001 (T9605 of 2001) implemented in the award.

[3] By means of sequential exhibits, the Union was able to demonstrate an administrative error which resulted in the award being omitted from the safety net adjustments available under the 1999, 2000 and 2001 State Wage Case decisions.

[4] The Tasmanian Chamber of Commerce and Industry Limited did not support the application but acknowledged that the omissions had occurred.

[5] I am satisfied that the award should be varied in the manner sought and that, in so doing, the Principles of the Commission and the provisions of the Act, in particular those relating to the public interest, will not be contravened.

[6] An order is attached.
