Award variation - restructure of award - consent matter - application granted - award varied - operative date ffpp 1 August 2003 REASONS FOR DECISION [1] On 11 September 2002, an application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Butter and Cheesemakers Award. [2] Hearings were convened at the Commonwealth Law Courts, 39-41 Davey Street, Hobart at 10.30 am on Friday 4 October 2002 and Friday 17 January, at 2.30 pm on Tuesday 4 March, at 9.30 am on Thursday 15 May and at 1.00 am on Thursday 17 July 2003. [3] At the hearings Mr R Flanagan appeared on behalf of the Australian Workers' Union, Tasmania Branch and Mr I Paterson appeared for the Australian Services Union (Tasmania Branch). Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited on Friday, 4 October 2002 and Tuesday 4 March 2003 [4] The application sought to vary and reformat the Butter and Cheesemakers Award and to address the minimum rates adjustment process. [5] The consolidated document incorporates the State Wage Case decision of the Full Bench, T10886 etc of 2003 of 10 July 2003. [6] Given the submissions of the parties and the degree of consent, I approve the variation to the award in the manner sought in the draft Order attached to the application. The variation shall come into operation on and from 1 August 2003. I am satisfied that it does not offend the public interest or the Wage Fixing Principles. [7] The Order giving effect to this decision is attached.
